SharkNinja Candidate Privacy Notice

At SharkNinja, we exist to deliver on our mission of “positively impacting people’s lives, every day in every home.” This includes doing everything possible to protect your privacy and secure your personal information.

This Candidate Privacy Notice describes how SharkNinja Operating LLC and SharkNinja Europe Ltd (hereinafter and together “SharkNinja” or, individually and for the purpose of local recruitment, “Local SharkNinja”), as the data controller(s), handle and protect your Personal Data in connection with SharkNinja’s recruiting processes and programs. In case of a conflict between this Privacy Notice and applicable law, applicable law will govern.

Personal Data”, “Processing”, and other terms that are capitalized in this Privacy Notice but not otherwise defined herein, shall have the same meaning as in the the EU General Data Protection Regulation 2016/679 (“GDPR”).

This Privacy Notice only applies to the Personal Data of job applicants, potential candidates for employment or partnership, and those who participate in our recruiting programs and events. This Personal Data is submitted directly to SharkNinja through the online application process and follow-up communications and/or through alternative channels (e.g., via professional recruiting firms).

By submitting your Personal Data to us, you acknowledge that:

  • You have read and understood this Privacy Notice.
  • Your Personal Data may be transferred and processed globally for the purposes and in the manner specified in this Privacy Notice.
  • You are not required to provide any requested information to us, but your failure to do so may result in our not being able to continue your candidacy for the job for which you have applied.
  • This Privacy Notice does not form part of any contract of employment offered to candidates hired by SharkNinja.

Personal Data we collect.

The types of Personal Data that we request from you and the ways that we process it are determined by the requirements of the country in which the relevant Local SharkNinja entity which may hire you is established and where the role you apply for is located, and not the country in which you reside. Should you apply to more than one location or should the role to which you apply be available in more than one country, the types of Personal Data we request from you and the ways that we process it are determined by the requirements of all the countries in which the position is located.

We collect these Personal Data directly from you when you apply for a role with us:

If you receive an offer from us, we may conduct a background check on you, or instruct a third party to do so on our behalf.

Background screening will only be done where permitted by the law applicable to the Local SharkNinja entity which would be hiring you, and to the extent necessary and proportionate to the role you are being offered.

Where mandated under applicable local law: necessity for compliance with a legal obligation.

Otherwise, our legitimate business interests in evaluating your application.

Where special categories of data are involved, either further to such data being manifestly made public by you or your consent.

To the extent permitted by applicable law, we may also collect data related to criminal offences and proceedings.

Our Legitimate Interests

To the extent permitted by applicable law: Race, gender, sexual orientation, Socio Economic information, veteran status, work authorization, ADA status, ability to work onsite.

We collect Personal Data about you indirectly online to the extent that you have chosen to make this information publicly available. For example, we may find your profile on professional social media websites (such as LinkedIn) and contact you about suitable roles.

We also collect these Personal Data about you from the following third parties:

  • professional recruiting firms;
  • your references;
  • your prior employers;
  • SharkNinja employees with whom you have interviewed or who recommended your candidacy.

Sensitive Personal Data is a subset of Personal Data that includes ethnicity, health, trade union membership, philosophical beliefs, sexual orientation, and other categories as prescribed by law. We may collect sensitive Personal Data about a candidate to the extent permitted to do so by applicable laws (e.g., U.S. equal opportunity laws) and to support our efforts to create an inclusive and diverse work environment. We may also collect sensitive Personal Data to the extent that a candidate chooses, without being asked, to voluntarily share it during the recruitment process.

Cross-border Transfer and Use of Personal Data

Your Personal Data will be accessed by our recruitment team who operate globally. Individuals performing administrative functions and IT personnel within SharkNinja will also have limited access to your Personal Data to the extent necessary to perform their jobs. For transfer of your Personal Data to countries without an adequacy decision from the European Commission and/or the United Kingdom, SharkNinja has taken steps to ensure the adequate protection of your Personal Data by framing these transfers with the following appropriate safeguards: intra-company agreements including Standard Contractual Clauses and/or the UK International Data Transfer Addendum.

Sharing of your Personal Data with Third Parties

We use third-party service providers to support our recruitment processes such as to assist us in identifying and recruiting talent, administering, and evaluating pre-employment screening.

We will not sell your Personal Data to third parties.

If your Personal Data is shared with third parties for the purposes set out in this Notice, SharkNinja will take appropriate measures (including contractual) to ensure that such parties process your Personal Data in accordance with SharkNinja’s information security and privacy policies. Security

We are committed to protecting the security of the information we collect. SharkNinja maintains administrative, technical, organizational, and physical safeguards designed to protect against loss, misuse or unauthorized access, disclosure, alteration, or destruction of your personal information in accordance with applicable privacy and data security laws. It is your responsibility to protect the confidentiality of your passwords, account information, and any other access features associated with our recruitment process, as well as to adhere to any applicable Terms of Use.

Deletion and Retention of Personal Data

Data Retention

If you accept an offer of employment with us, any relevant Personal Data collected during your pre-employment period will become part of your personnel records and will be retained in accordance with specific country requirements and with the privacy notice applicable to SharkNinja employees, which will be provided during our on-boarding process.

If we do not employ you, we may nevertheless continue to retain and process your Personal Data for up to two years (dependent on the country) for administration purposes, to consider you for potential future roles, and to monitor the quality of our recruitment. After this period, we will only retain anonymous data for business analytical purposes.

Your Rights

We take reasonable steps that are designed to keep your Personal Data accurate, complete, and up to date for the purposes for which it is collected and used. We also have implemented measures that are designed to help ensure that our processing of your Personal Data complies with this Privacy Notice and applicable law.

In accordance with the applicable law of your country of residence, you will have one or more of the following rights:

  • a right to request information about the Personal Data we hold about you, including the details of how we use that information and who we share it with;
  • a right to request a copy of the Personal Data that we hold about you;
  • a right to amend or rectify your Personal Data if any of the information held about you is incorrect or out of date;
  • a right to portability of your Personal Data, where the personal data has been collected further to the necessity for the execution of (pre)contractual measures or your consent and processed by automated means;
  • a right to request erasure of your Personal Data;
  • where we are processing your personal information based on a legitimate interest (or those of a third party) you may object to processing on this ground
  • a right to demand that we restrict the processing of your Personal Data;
  • a right to withdraw your consent to the processing of your Personal Data, to the extent our processing relies on your consent as the lawful basis for processing;
  • a right to provide us with instructions as to the processing of your Personal Data in case of death;
  • California Consumer Privacy Act (CCPA) permits California residents to annually request, and obtain, a list of third parties we disclosed Personal Data to and what was shared.

SharkNinja does not sell or share Personal Data with third parties.

Changes to the Privacy Notice

We will regularly review and update this Notice, so we encourage you to review it periodically. If we change our privacy notice in a way that significantly changes how we process the personal information we hold about you, we will alert you to material changes by placing a notice on our websites.

Any significant changes in processing will come in to force no sooner than thirty (30) days after notification through this Notice.
