At SharkNinja, we exist to deliver on our mission of “positively impacting people’s lives, every day in every home. This includes doing everything possible to protect your privacy and secure your Personal Data”.
This Privacy Notice covers situations where we, SharkNinja, access, collect, store, process, use, disclose, transfer, or delete (hereinafter collectively referred to as “use”) Personal Data in paper or electronic form about persons working for or acting as our service providers, contractors, partners, suppliers (hereinafter collectively referred to as “third parties”).

Who is responsible for your Personal Data? 

SharkNinja Operating LLC, SharkNinja Europe, and SharkNinja (Hong Kong) Company Limited, operate as joint data controllers, which means we decide on the methods and purposes of the processing of your Personal Data by determining “why” and “how” it is collected and used.

SharkNinja Europe Ltd is based in the UK at 3150 Century Way, Thorpe Park, Leeds, West Yorkshire, LS15 8ZB.

SharkNinja (Hong Kong) Company Limited is based at 21/F 238 DES VOEUX RD C Sheung Wan Hong Kong.

What Personal Data do we collect and why?

We will collect, store, process, use, disclose and transfer your Personal Data to be able to identify you, and provide you with a smooth customer experience. We will use your Personal Data for the purposes described in this section. The processing of your Personal Data will comply with the applicable privacy legislation and rely on the legal basis set out in this section. Where we rely on our legitimate interests, we will only do so to the extent that your own interests or fundamental rights do not override our interests.

We may collect or receive the following Personal Data about you:

  • Contact details such as name, personal and professional addresses, telephone numbers, and internal & external email addresses,
  • Identity documents, signature, title, position, function, company information, photograph, experience, and education background.
  • Attendance and where applicable CCTV footage when entering our premises.
  • Email exchange
  • Electronic identification data including login, password, IP address and other online identifiers, and information if you access our systems and networks.
  • Contract, invoice & bank account information.
  • Where applicable information the results of background checks which may contain prior criminal prosecutions and/or convictions.
 

When and how might we collect your Personal Data

We will collect, store, process, use, disclose and transfer your Personal Data to be able to identify you, and provide you with a smooth customer experience. We will use your Personal Data for the purposes described in this section. The processing of your Personal Data will comply with the applicable privacy legislation and rely on the legal basis set out in this section. Where we rely on our legitimate interests, we will only do so to the extent that your own interests or fundamental rights do not override our interests.

We will only process Personal Data strictly necessary for the purposes defined above. In the event you do not provide such information, we will not be able to perform these purposes.

We may collect your Personal Data when:

    • If you visit our locations, we will collect Personal Data as part of visitor registration and where applicable online NDA process and CCTV security and safety system.
    • You are directly appointed by us to provide products and services or when you participate in our procurement process, or when the company you work for is appointed by us and you have a work assignment with us in this context.
    • As part of procurement operations, and to comply with our obligations in terms of anti-corruption, we may also have to consult public registers to verify that your company or its legal representatives are not subject to prosecution or of criminal convictions.

Children

Our products and our websites are not designed for children. If we become aware that we have collected personal information (as defined by the United States Children’s Online Privacy Protection Act) from children, we take every reasonable effort to delete such data.

If we do unintentionally collect children’s personal information, we will delete it as soon as we become aware.

How long will we retain your Personal Data?

We may retain some of your Personal Data for a shorter or longer time, for instance, where we are obliged to do so in accordance with relevant legal requirements.

How do we protect your Personal Data?

SharkNinja are strongly committed to keeping your Personal Data safe. We have adopted specific technical and organizational measures to protect your Personal Data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure, or access.

When you perform your assignments within our premises or access to our IT system, you agree to comply with the SharkNinja guidelines in terms of cybersecurity defined in the documentation provided when you enter our services.

If you have any concerns that your Personal Data has been put at risk, for example if your security credentials may have been compromised, you should contact us as soon as possible.

International Transfer of Personal Data

We operate globally and may transfer your Personal Data to other offices in SharkNinja, or to approved partners in locations around the world. When we do this, it will always be for the purposes described in this privacy notice, and where we are satisfied with the levels of protection and security implemented in compliance with applicable privacy legislation. Transfers of Personal Data within SharkNinja (including those outside the EEA) are governed by an intercompany agreement.

When we share, use, or transfer Personal Data with other organizations particularly outside the EEA, we use approved standard contractual clauses, or put in place other measures under applicable privacy legislation, to ensure that these transfers provide adequate safeguards.

  • Law enforcement bodies, regulatory bodies, government agencies, courts and/or lawyers to comply with applicable laws and defend our rights and interests.
  • Stakeholders involved in the selling or reorganization of any part of our business or assets (for example potential buyers and their advisors).

All parties are bound by an obligation to implement appropriate security measures to protect Personal Data they process and are bound by a strict confidentiality agreement and specific contractual terms on “how” and “when” they are allowed to use your Personal Data on our behalf.

Do we sell your Personal Data? 

We do not sell your Personal Data to third parties. We share your Personal Data with carefully selected service providers so they can provide services to you on our behalf to help us fulfil our contractual obligations, or who otherwise assist us in carrying out the purposes we describe in this Privacy Notice. We have contracts in place with these providers that stipulate they cannot do anything with your Personal Data without instruction from us and that they provide their service via secure methods.</br></br>

To the extent our transfer of your Personal Data to certain third parties may be interpreted as a “sale” under California, or other applicable privacy law, you have the right to opt out of that sale, to exercise this right, please submit your request by filling out the form after clicking here.

Your Data Protection Rights

Subject to your applicable privacy legislation, you may be entitled to one or more of the following rights and exercise them on your own or via a representative acting on your behalf. We are committed to protecting your rights and allowing you to exercise them. You will never be discriminated against when you exercise your right in good faith under any applicable privacy law.

  • Right to access Personal Data held about you and to ask for copies of your Personal Data.
  • Right to request us to make any changes and rectify your Personal Data if you think it is inaccurate. You also have the right to ask for information to be completed if you think it is incomplete.
  • Right to ask for your Personal Data to be deleted.
  • Right to restriction of processing your Personal Data in certain circumstances.
  • Right to object to processing your Personal Data where the processing of your Personal Data is based on our legitimate interests. If we use your Personal Data for direct marketing, you can ask us to stop, and we will comply with your request.
  • Right to object to and not be subject to a decision which is based solely on automated processing (including profiling) which may produce legal effects concerning you or could significantly affect you.
  • Right to data portability. You can ask us to transfer your Personal Data to you or to a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies in certain circumstances.
  • Where we rely on legitimate interest to process Personal Data, you may have the right to object to that processing. In this case, we must stop using your Personal Data for that purpose unless we can either demonstrate compelling legitimate grounds for processing that override your interests, rights and freedoms or where we need to process the Personal Data in order to establish, exercise or defend legal claims. Where we rely on legitimate interest as a justification for processing, we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis.
  • Opt-out Right / Do Not Sell My Personal Information: applicable legislation such as CCPA sets forth certain obligations for businesses that “sell “personal information to third parties. You can request that we not sell your personal information.
 
Right to lodge a complaint

You also have the right to lodge a complaint with your local supervisory authority, State Attorney General’s Office, or other applicable regulator, dependent on your place of residence, if you consider that the processing of your Personal Data infringes applicable law.
